Terms of Service

1. Agreement

These terms are an agreement between you and Antonio Lopes (“nichospt”, “we”, “us”). By installing or using one of our apps, you agree to them. If you use an app on behalf of an organisation, you agree on its behalf and confirm that you are allowed to do so. If you do not agree, do not install or use the apps.

2. Platforms and marketplaces

Our apps are add-ons for third-party platforms and are distributed through those platforms' marketplaces. At present that means PDF Annotator for monday.com, distributed through the monday.com Apps Marketplace.

• You need your own account on the platform, and its terms continue to apply to you.
• We are an independent developer. We are not part of, and are not endorsed by, the platforms our apps work with.
• We are not responsible for the platform itself, including its availability, its features or changes it makes that affect an app.

3. Using the apps

Subject to these terms, you may use each app for your own or your organisation's internal purposes, on the plan you have chosen. You agree not to:

• use an app unlawfully, or to process content you have no right to use;
• try to get around plan limits, access controls or other technical restrictions;
• interfere with or overload an app, or probe it for vulnerabilities without our written permission;
• copy, resell, reverse engineer or build a competing product from an app, except where the law gives you that right regardless of these terms.

4. Plans and billing

PDF Annotator for monday.com is planned to be offered on these plans:

• Free: 3 saved annotated PDFs per calendar month, per monday account.
• Pro Unlimited: unlimited saved annotated PDFs.

A save is counted when an annotated PDF has been successfully saved back to monday, whether it is a first save, an update of an earlier annotated version, or a copy. Opening a document, annotating it, cancelling, or a save that fails does not count. The count is shared by everyone in the monday account and starts again at the beginning of each calendar month (UTC). Unused free saves do not carry over to the next month.

The price of paid plans, and any trial, is shown in the app's marketplace listing. Subscriptions are purchased, billed, renewed and cancelled through monday.com using its own billing system. We do not take payment from you directly. Payment terms, taxes and refunds are therefore governed by monday.com's terms and policies.

We may change the plans, limits or prices offered in future. Changes to a paid plan will not apply to a period you have already paid for.

5. Your content

Your documents and annotations remain yours. You give us only the permission needed to run the app for you: to fetch a file you select, display it to you, and add the annotated copy back to your monday account.

PDF Annotator is designed never to overwrite or delete the original file. The annotated version is added as a separate file. Even so, you are responsible for your own content, including keeping copies of anything important and checking that an annotated document is correct before relying on it.

7. Our intellectual property

The apps, this website and the nichospt name and logo belong to us or our licensors. These terms do not transfer any ownership to you. If you send us feedback or suggestions, we may use them without any obligation to you.

8. Availability and changes

We work to keep the apps available and working, but we do not promise uninterrupted or error-free service. Apps depend on the platform they run in, and may be unavailable during maintenance or because of problems outside our control. We may add, change or remove features, and we may stop offering an app.

9. No warranty

To the fullest extent permitted by law, the apps and this website are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms removes rights that you have by law and that cannot be excluded.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill, arising from your use of the apps or this website. Our total liability for any claim relating to an app is limited to the total amount you paid for the app in the 12 months before the event that gave rise to the claim.

Nothing in these terms limits liability that cannot be limited by law.

11. Ending use

You can stop using an app at any time by uninstalling it from your platform account. Paid subscriptions are cancelled through the platform. We may suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law or by the platform. Sections that by their nature should continue to apply after use ends, such as those on intellectual property, warranty and liability, will continue to apply.

12. Governing law

These terms are governed by the laws of Portugal. Disputes will be handled by the courts of Portugal. If you are a consumer, this does not take away any protection given to you by the mandatory laws of the country where you live.

13. Changes to these terms

We may update these terms. The current version will always be on this page, with its effective date. Notice of material changes: at least 30 days, given by updating this page. If you keep using an app after a change takes effect, you accept the updated terms.
